Leveraging our core and differentiated strengths, we provide you with high-quality, comprehensive technology services
More
We provide professional optical product testing services (laser product safety testing and performance parameter testing, photobiological safety testing for non‑laser products), as well as energy efficiency testing services (EU ErP energy efficiency testing, US DOE energy efficiency testing, California CEC energy efficiency testing), among others.
If you have requirements for laser products (laser product safety testing and laser performance parameter testing) and energy efficiency testing (EU ErP energy efficiency testing, US DOE energy efficiency, California CEC energy efficiency, UK energy efficiency testing), please feel free to email us at: admin@ctnt-cert.com
1、 Regulatory background and regulatory body
Laser flashlights (products that integrate strong light flashlights with laser modules) belong to the Radiation Emitting Electronic Products (RED) category in the United States and are regulated by the FDA's Center for Devices and Radiological Health (CDRH). The core regulations are:
21 CFR 1040.10 (Laser Product Performance Standard): specifies radiation safety limits, design requirements, and labeling requirements for laser products. Products that do not comply with this standard shall not be imported or sold in the United States
21 CFR 1040.11 (Special Purpose Laser Products): Additional requirements may apply if the product involves demonstration/entertainment purposes
21 CFR 1010 (General Requirements): Basic provisions for certification labels, identification labels, etc
2、 Laser level classification
The FDA classifies lasers into six categories based on their hazard levels: Class I, IIa, II, IIIa, IIIb, and IV. For the laser indication function integrated into flashlights, the output power generally needs to be controlled below 5mW (corresponding to Class IIIa/IEC 3R). Selling a "laser indicator" beyond this limit is illegal in the United States. Different levels correspond to different safety design requirements (such as Class IIIb requiring key switches, remote interlocking interfaces, etc.).
3、 Core of Registration: Product Report and Attachment Number
The FDA does not issue traditional "certification certificates", and the core of compliance is:
Enterprise registration: Manufacturers register their enterprise information in the FDA system and obtain FEI codes
Product classification: Determine laser grade based on wavelength, power, pulse mode, etc
Prepare Laser Product Report: including product description, laser parameters, optical and circuit diagrams, safety design instructions, quality control documents, label samples, user manuals, etc
Submission for record: submitted through the FDA eSubmitter system
Obtain Attachment Number: After approval, FDA assigns a unique filing number, which is a compliance certificate that must be declared during import customs clearance
Attention: Each model must apply for an Attachment Number separately, and multiple models cannot share one.
4、 Laser Notice 56 simplifies the path
The FDA issued Laser Notice 56 in 2019, allowing manufacturers to adopt the classification and labeling system of international standard IEC 60825-1 instead of the native classification labeling requirements of 21 CFR 1040.10. This allows businesses to meet both international and US market requirements with the same set of classifications and labels. However, it should be noted that it does not exempt registration obligations - product reports and Attachment Numbers still need to be applied for. When using this path, the label must indicate a declaration that complies with IEC 60825-1 and Laser Notice 56.
5、 Label requirements
The product must come with: identification label (manufacturer name, address, production date), certification label (conformity statement), warning label (including laser grade, wavelength, output power), and aperture label. Warning labels are mandatory for levels IIIa and above.
6、 Import customs clearance
When importing, importers must fill out FDA Form 2877 (Electronic Product Import Declaration Form Subject to Radiation Control Standards), declare manufacturer information, place of origin, product description, model, and cite the corresponding Attachment Number of the product. If the product is within the scope of FCC control (such as including wireless modules or electronic circuits), relevant FCC certifications must also be completed.
7、 Subsequent obligations
Annual report: submitted before September 1st each year, reporting on the quantity, quality control, safety related complaints, etc. of products sold to the United States in the previous year (July 1st to June 30th)
Supplementary Report: When there is a significant change in product design (replacement of laser, adjustment of power, change of enterprise information, etc.), it must be resubmitted
Record keeping: Sales and transportation records must be available for FDA review
8、 Common precautions
The FDA does not issue physical certificates, and any institution claiming to handle "FDA laser certification certificates" is false advertising
Class I products (<1mW and fully enclosed with no exposure risk) are exempt from product reporting, but must still meet labeling and design safety requirements
During mass production, it is necessary to ensure that the actual shipped products are completely consistent with the recorded technical data
